1. Preamble

This Return and Refund Policy (hereinafter the "Policy") sets out the conditions under which products ordered on the kurtens.com website may be subject to a claim, return, replacement or refund.

The Site is published and operated by WAVE LLC (Kurtens is a brand of WAVE LLC), a limited liability company (LLC) registered in New Mexico (United States) under number 0008083440, with its registered office at 1209 Mountain Road Pl NE, Ste N, 87110 Albuquerque, New Mexico, United States (hereinafter the "Seller").

Important — two product ranges with distinct rules: Kurtens offers curtains in standard (fixed) sizes and made-to-measure curtains manufactured to your specifications. Your return rights differ depending on the type of product ordered.

3. Right of withdrawal — Standard curtains (30 days)

3.1. Principle and time limit

Kurtens grants a commercial withdrawal guarantee of 30 calendar days from receipt of your order to exercise your right of withdrawal on a standard curtain, without having to justify your decision. This 30-day period is more favorable than the legal minimum of 14 days provided for by the applicable legislation (art. L. 221-18 French Consumer Code; art. VI.47 Belgian Code of Economic Law; § 355 German BGB; art. 104 of the Spanish TRLGDCU; art. 52 of the Italian Consumer Code; art. 10 of Portuguese Decree-Law no. 24/2014; Directive 2011/83/EU applicable in Luxembourg; Regulation 30 of the Consumer Contracts Regulations 2013 for the United Kingdom; art. 40d Swiss Consumer Credit Act).


3.2. Product condition requirements

To be accepted as a return under the right of withdrawal, the standard curtain must be:

  • Unused, uninstalled, unwashed, unmodified
  • In its complete original packaging (bag, labels, accessories)
  • Free of any signs of use (mounting holes, hanging creases, fragrance, dust)

Any curtain showing signs of use cannot be accepted as a return for a change of mind.


3.3. Withdrawal procedure

  • Send an email to contact@kurtens.com within the 30-day period, with your order number and your wish to withdraw (or use the form in section 13).
  • We acknowledge receipt within 24 business hours.
  • You have an additional 14 days to return the product to the address provided.
  • Pack the product carefully and ship it with a tracked service. Return costs are borne by you. As the return is made under your responsibility, we strongly recommend using a shipping method with a tracking number and insurance. Kurtens cannot proceed with a refund or exchange if the parcel is lost by the carrier during the return shipment.
  • Upon receipt and inspection of the product, we issue the refund within 14 days.

Swiss and British customers benefit from the same 30-day commercial right of withdrawal for standard curtains. Customs formalities may apply for returns from Switzerland or the United Kingdom.


3.4. Refund following withdrawal

The refund covers the price of the product and the initial delivery costs (standard rate). It is made using the same payment method as that used for the order (bank card, PayPal or Apple Pay), within 14 days following receipt of the returned product.

Return costs (withdrawal, standard curtain) are borne by the Customer and will be deducted from the refund if the Customer uses a service offered by Kurtens, or paid directly by the Customer if they choose their own carrier.


4. Right of withdrawal — Made-to-measure curtains (legal exclusion)

As made-to-measure curtains are manufactured to your dimensions, colors and personal options, the 14-day right of withdrawal does not apply. This exclusion is provided for by:

  • France: art. L. 221-28, 3° of the Consumer Code
  • Belgium: art. VI.53, 3° of the Code of Economic Law
  • Germany: § 312g para. 2 no. 1 of the BGB
  • Spain: art. 103 c) of the consolidated text of the General Law for the Protection of Consumers and Users (RDL 1/2007)
  • Italy: art. 59, para. 1, letter c) of the Consumer Code (D.Lgs. 206/2005)
  • Portugal: art. 17, no. 1, letter c) of Decree-Law no. 24/2014
  • Luxembourg: art. L. 222-9 (3°) — Directive 2011/83/EU
  • Switzerland: general practice / art. 40d para. 1 let. c Consumer Credit Act
  • United Kingdom: Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

Legal reminder — Art. L. 221-28, 3° of the Consumer Code (FR):

"The right of withdrawal may not be exercised for contracts: [...] 3° For the supply of goods made to the consumer's specifications or clearly personalized."

No return or refund can be granted for a made-to-measure curtain that conforms to your order if you have changed your mind, if the color does not suit you aesthetically, or if you have made a measurement error.

5. Exact-Fit Guarantee — Made-to-measure protection option

5.1. Overview

The Exact-Fit Guarantee is an optional, paid commercial guarantee (€29.90) offered by Kurtens when ordering a made-to-measure curtain. It provides free remanufacturing of the curtain in the event of a measurement error made by the Customer, a case that is not covered by the legal right of withdrawal or by the legal guarantees.

5.3. Conditions of use

  • The guarantee must be purchased at the time of ordering the made-to-measure curtain
  • It is valid for 30 days from the date of receipt of the curtain
  • It covers 1 remanufacture per curtain ordered with the option
  • The Customer must activate their guarantee at kurtens.com/pages/activer-garantie-exact-fit before submitting a request
  • The old curtain must be returned to Kurtens (return mandatory — label provided)
  • The remanufactured curtain will be identical in color and fixing type; only the dimensions change


5.4. How to use it

  • Activate your guarantee at kurtens.com/pages/activer-garantie-exact-fit (mandatory first step).
  • Submit your request at kurtens.com/pages/utiliser-la-garantie-exact-fit, attaching: your order number, a photo of the installed curtain, a photo of the issue, and your desired new dimensions.
  • Our team confirms and starts manufacturing within 24 business hours.
  • The new curtain is shipped within 5 to 7 business days.
  • Return the old curtain with the prepaid label provided by Kurtens.

The Exact-Fit Guarantee is in addition to the legal guarantees — it does not replace them. In the event of a manufacturing defect or non-conformity with the order, the legal guarantees apply independently.

The Exact-Fit Guarantee only covers measurement errors made by the Customer. It does not cover manufacturing defects, which fall under the legal guarantee of conformity (section 7).


5.5. Legal nature

In accordance with art. L. 217-21 of the Consumer Code, the Exact-Fit Guarantee is a commercial guarantee in the legal sense of the term. It is in addition to the consumer's legal rights without restricting or replacing them. In the event of a conflict between the conditions of this commercial guarantee and the Customer's legal rights, the legal rights always prevail.


6. Obligation to inspect on receipt

Upon receipt of your order, you must check:

  • The external condition of the packaging (absence of transport-related damage)
  • That the product matches your order (dimensions, colors, technical options)
  • The absence of any visible manufacturing defect (seams, finishes, technical mechanisms)
  • The quantity of products received against the order

If an anomaly is noted at delivery, make precise reservations on the carrier's delivery note, then report the issue to the Seller under the conditions described in section 9.


7. Legal guarantee of conformity

7.1. Principle and duration

Whatever the range (standard or made-to-measure), you benefit from the legal guarantee of conformity for at least 2 years from delivery (up to 3 years in Spain and Portugal; specific arrangements for the United Kingdom set out in the table below). The Seller is required to deliver goods that conform to the contract.

Consumer Rights Act 2015 — 30-day right to reject, then repair/replacement


* United Kingdom: short-term right to reject non-conforming goods within 30 days; thereafter, a right to repair or replacement, then to a price reduction or final rejection. The limitation period for bringing a claim is 6 years (England and Wales) or 5 years (Scotland).

7.2. Presumption that the defect pre-existed

In accordance with art. L. 217-7 of the Consumer Code (and equivalent EU provisions), defects appearing within the first 24 months following delivery are presumed to have existed since manufacture. You do not have to prove their origin.

7.3. Your rights in the event of a conformity defect

a) Repair or replacement (first remedy) — In the event of a proven conformity defect, you may choose between repair and replacement of the product. The product must be brought into conformity within 30 days of your request, at no cost to you.

b) Price reduction or full refund (second remedy) — If bringing the product into conformity is refused, impossible, not carried out within 30 days, or if the defect is so serious that it justifies immediate cancellation, you are entitled to a price reduction or a full refund.

Return costs under the legal guarantee of conformity are fully covered by Kurtens (prepaid label provided).

7.4. Suspension of the guarantee period

The guarantee period is suspended for the duration of the repair or replacement. It restarts from the handover of the repaired or replaced item.

 

8. Legal guarantee against hidden defects

8.1. Principle

In accordance with art. 1641 to 1649 of the Civil Code (and art. 197 et seq. CO for Switzerland, as well as the equivalent provisions of the applicable national law in the other countries of delivery), the Seller is liable under the guarantee for hidden defects that render the item unfit for its intended use, or that substantially reduce its use.

8.2. Conditions of application

To be covered by this guarantee, the defect must:

  • Have existed at the time of sale
  • Be hidden, i.e. not apparent during a normal inspection on receipt
  • Be serious enough to render the item unfit for its use or to substantially reduce its use

8.3. Your rights in the event of a hidden defect

In the event of a proven hidden defect (art. 1644 of the Civil Code), you may choose between:

  • The rescission action: return the item and obtain a full refund of the price paid
  • The price-reduction action: keep the item and obtain a reduction in price

The action must be brought within 2 years from the discovery of the defect. Return costs are fully covered by Kurtens.


9. Return procedure — all cases

  • Contact us by email at contact@kurtens.com with your order number, the reason for the return and photos if applicable (defect, non-conformity, damage).
  • We acknowledge receipt within 24 business hours and communicate our decision within 14 business days at most.
  • If the return is approved for a defect / non-conformity / shipping damage: we send you a prepaid return label. For a withdrawal (standard curtain): return costs are borne by you.
  • Pack the product carefully in its original packaging or in equivalent protective packaging.
  • Drop off the parcel with the designated carrier and keep your proof of shipment.
  • Upon receipt and inspection of the product, we proceed with the replacement or refund within 14 days.

Returns from Switzerland or the United Kingdom: customs formalities may extend the time by 3 to 7 days. Kurtens provides all the necessary documents with the return label.


10. Refund terms

10.1. Time limit

The refund is made within a maximum of 14 days from receipt of the returned product, or from proof of its shipment by the Customer, whichever occurs first.

10.2. Refund method

In accordance with art. L. 217-14 of the Consumer Code, the refund is made using the same payment method as that used for the order (bank card, PayPal or Apple Pay), unless the Customer expressly agrees to another method.

11. Cases excluded from the guarantee and returns

Measurement error communicated by the Customer (made-to-measure only)

If the product conforms to the order specifications but the Customer has made an error in the measurements or options provided, no refund or return will be granted. The Seller strongly encourages the Customer to check all measurements before confirming.

Misuse or improper installation

Damage resulting from use that does not comply with the instructions, from incorrect installation or from abnormal use is not covered.

Normal wear

Normal wear from regular use under normal conditions constitutes neither a conformity defect nor a hidden defect.

Modification of the product by the Customer

Any modification, alteration or repair of the product carried out by the Customer or a third party without the prior written agreement of the Seller results in the loss of the guarantees.

Shipping damage not reported within the time limits

Visible damage attributable to transport must be reported to the carrier on the delivery note AND to the Seller within 3 business days following receipt.

13. Combination of guarantees

The legal guarantees of conformity and against hidden defects apply independently of each other. You may choose to rely on whichever is most favorable to you, in accordance with art. L. 217-3 of the Consumer Code.


14. Dispute resolution

In the event of a dispute, we invite you to contact us first at contact@kurtens.com to find an amicable solution.

  • France: the consumer mediator to which the Seller is affiliated (art. L. 612-1 et seq. of the Consumer Code), contact details provided on request to contact@kurtens.com. The European online dispute resolution platform was closed on 20 July 2025 and is no longer available.

15. Amendment of this Policy

The Seller reserves the right to amend this Policy at any time. The applicable version is the one in force on the date of the order. Any amendment will be published on the Site and will take effect as soon as it goes online.
