Article 1 — Purpose and scope

1.1. Purpose

These general terms and conditions of sale (hereinafter the "GTC") set out the rights and obligations of the parties in connection with the online sale of curtains offered by the Seller on the website kurtens.com (hereinafter the "Site"). Kurtens offers two product ranges: standard-size curtains and made-to-measure technical curtains.

1.2. Scope

These GTC apply to any order placed by a consumer or non-professional (hereinafter the "Customer") residing in mainland France, Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland or the United Kingdom, and placing an order on the Site for delivery to one of these countries.

The GTC are accessible at any time on the Site and prevail over any other general or specific terms not expressly agreed by the Seller.

1.3. Acceptance

Validating the order implies the Customer's full and unreserved acceptance of these GTC. The Customer declares having read them prior to placing the order. To this end, a checkbox "I have read and accept the General Terms and Conditions of Sale" is presented to the Customer before the final validation of the order.

1.4. Enforceability

The applicable GTC are those in force on the date the order is placed. The Seller reserves the right to amend them at any time; the new GTC will apply only to subsequent orders.

Article 3 — Products

3.1. Description

Kurtens offers two types of product:

  • Standard-size curtains: products available in fixed dimensions, presented on the Site with their specifications.
  • Made-to-measure technical curtains: the Customer defines the characteristics of the product when ordering: dimensions (width, height), color, fabric type and technical options (fixing type, lining, etc.).

Each product has a description sheet presenting its essential characteristics within the meaning of article L. 111-1 of the French Consumer Code. The photographs illustrating the products on the Site are not contractual; slight differences in shade may exist between the on-screen rendering and the actual product.

3.2. Manufacturing tolerances

For made-to-measure products, slight dimensional variations are inherent to the manufacturing process. A tolerance of ± 2 cm on the ordered dimensions is considered acceptable and does not constitute a lack of conformity. Likewise, slight shade variations between different fabric batches may occur without constituting a defect.

3.3. Availability

Standard curtains are available in stock. Made-to-measure curtains are manufactured to order. In the event of temporary unavailability of a fabric or technical option, the Seller will inform the Customer as soon as possible and will offer, at the Customer's choice, a substitute product of equivalent quality or a full refund of the order.


Article 4 — Orders

4.1. Ordering process

Orders are placed online on the Site according to the following steps:

  • Selecting the product and, for made-to-measure items, configuring the specifications (dimensions, color, technical options)
  • Adding to the cart and reviewing the order summary
  • Entering the delivery and billing information
  • Accepting these GTC by ticking the box provided for that purpose
  • Choosing the payment method and final validation of the payment

4.2. Order confirmation

After payment validation, the Customer receives an order confirmation email at the email address provided, summarizing the order details (product, specifications, price, delivery address). This email constitutes the acknowledgement of receipt within the meaning of article 1127-2 of the French Civil Code and serves as proof of the contract.

4.3. Verification of specifications

The Customer is solely responsible for the accuracy and completeness of the specifications provided when ordering (dimensions, color, options). The Seller cannot be held liable for a product that does not meet the Customer's expectations if the order specifications were respected. The Customer is invited to check the measurements and options with the utmost care before validating the order.

4.4. Order modification and cancellation

For made-to-measure curtains, any request to modify or cancel an order must be sent to the Seller by email at contact@kurtens.com as soon as possible after the order is placed. The Seller will endeavor to act on the request, provided that manufacturing of the product has not yet begun. If manufacturing has already started, the modification or cancellation cannot be accepted, in line with the made-to-measure nature of the product.

For standard curtains, the order can be cancelled before shipment. After shipment, the withdrawal conditions apply.

4.5. Order refusal

The Seller reserves the right to refuse or cancel any order for legitimate reasons, in particular: an abnormal order or one placed in bad faith, an existing dispute with the Customer regarding payment of a previous order, suspicion of fraud.


Article 5 — Prices

5.1. Currency and taxes

Product prices are stated in euros (€) — or in the local currency displayed at the time of the order, in particular Swiss Francs (CHF) for Switzerland — inclusive of all taxes, including the VAT applicable on the day of the order for deliveries within the European Union. For shipments outside the European Union (Switzerland, United Kingdom), prices are displayed exclusive of import taxes: VAT and any customs duties are collected at import and remain the responsibility of the Customer (see the Shipping Policy). Delivery is free, with no minimum purchase, for all orders, whatever the country of destination served (France, Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland and the United Kingdom).

5.2. Price changes

The Seller reserves the right to change its prices at any time. Products are invoiced on the basis of the rate in force at the time the Customer validates the order.

5.3. Pricing error

In the event of an obvious pricing error (derisory price, transposed figures), the Seller reserves the right to cancel the order, even after confirmation. The Customer will be informed as soon as possible and the amount charged will be fully refunded.


Article 6 — Payment

6.1. Accepted payment methods

The Customer can pay for the order using the following payment methods: bank card (Visa, Mastercard, American Express), PayPal and Apple Pay.

PayPal may offer deferred or instalment payment options according to its own eligibility conditions. The Seller is not involved in these arrangements; they fall exclusively within the relationship between the Customer and PayPal.

6.2. Payment security

All transactions are secured by Shopify Payments, a PCI-DSS (Payment Card Industry Data Security Standard) certified provider. The Customer's bank details are encrypted and transmitted directly to the payment providers; they are at no point collected, stored or accessible by the Seller.

6.3. Time of charge

For payments by bank card, PayPal and Apple Pay, the total order amount is charged when the order is validated.

6.4. Payment failure

In the event of payment failure, refusal of authorization by the banking institution or rejection of the payment by the payment provider, the order is automatically cancelled and the Customer is informed by email.


Article 7 — Manufacturing and lead times

7.1. Manufacturing time

Standard curtains are prepared and shipped within 48 business hours from order confirmation.

Made-to-measure curtains require a manufacturing time of 5 to 7 business days from order confirmation. This time is fixed and tied to the personalized nature of the products.

7.2. Delivery time

Once the product has been manufactured (or prepared, for standard items) and handed over to the carrier, the delivery times are as follows:

  • Mainland France: 5 to 10 business days
  • Belgium, Luxembourg, Germany, Spain, Italy and Portugal: 5 to 10 business days
  • Switzerland: 5 to 10 business days (plus any customs clearance)
  • United Kingdom: 5 to 10 business days (plus any customs clearance)

7.3. Indicative total time

For made-to-measure curtains: the total time between order confirmation and receipt is estimated at 10 to 17 business days depending on the destination. For standard curtains: 10 to 15 business days depending on the destination. These times are indicative and may vary.

7.4. Maximum time

In accordance with article L. 216-1 of the French Consumer Code, in the absence of an indication or of compliance with the agreed time, the Seller delivers the goods within a maximum of thirty (30) days from the conclusion of the contract.


Article 8 — Delivery

8.1. Delivery area

Deliveries are made in mainland France (including Corsica), Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland and the United Kingdom. The French overseas departments and regions (DOM-TOM), the overseas collectivities, territories subject to a specific customs or fiscal regime (notably the Canary Islands, Ceuta and Melilla) and any international destination not listed are expressly excluded.

8.2. Delivery method

Delivery is made to the home only, to the address indicated by the Customer when ordering.

8.3. Carrier

Parcels are shipped via our partner carriers for France (La Poste), Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland and the United Kingdom. The Seller reserves the right to use another carrier if logistical conditions warrant it.

8.4. Delivery charges

Delivery is free, with no minimum purchase, for all orders to all the countries served (mainland France, Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland and the United Kingdom). For Switzerland and the United Kingdom (outside the European Union), import VAT and any customs duties remain the responsibility of the Customer, as set out in the Shipping Policy.

8.5. Parcel tracking

As soon as the parcel is shipped, an email containing the parcel tracking number is sent to the Customer.

8.6. Receipt and transfer of risk

The Seller is automatically liable to the Customer for the proper performance of the contract, including the obligations borne by service providers (the carrier), in accordance with article L. 216-4 of the French Consumer Code.

The Customer must check the condition of the parcel on receipt and, in the event of an anomaly, record precise reservations with the carrier on the delivery note, then report the problem to the Seller within three (3) business days at the address contact@kurtens.com.

8.7. Delivery delay

In the event the delivery time is exceeded, the Customer may give the Seller formal notice to deliver within a reasonable additional period. If delivery does not take place within this period, the Customer may terminate the contract and obtain a full refund within fourteen (14) days.

8.8. Address accuracy

The Customer is solely responsible for the accuracy of the delivery information. In the event of an error resulting in the inability to deliver or the return of the parcel, any reshipping charges may be invoiced to the Customer.


Article 9 — Right of withdrawal

9.1. Standard curtains — 30-day commercial guarantee

For standard-size curtains, Kurtens grants a commercial withdrawal guarantee of 30 calendar days from receipt of the order, without having to justify your decision. This 30-day period is more favorable than the legal minimum of 14 days provided for by article L. 221-18 of the French Consumer Code.

Conditions: the product must be unused, not installed, in its full original packaging, with no trace of use. Return charges are borne by the Customer.

9.2. Made-to-measure curtains — Legal exclusion

In accordance with article L. 221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts relating to "the supply of goods made to the consumer's specifications or clearly personalized".

As made-to-measure curtains are manufactured entirely to the dimensions, color and technical options chosen by the Customer, they constitute clearly personalized goods within the meaning of this provision. Consequently, no right of withdrawal applies to made-to-measure curtain orders.

This exclusion is provided for, in each country of delivery, by: art. L. 221-28, 3° of the Consumer Code (France); art. VI.53, 3° of the Code of Economic Law (Belgium); § 312g para. 2 no. 1 of the BGB (Germany); art. 103 c) of the TRLGDCU (Spain); art. 59, para. 1, letter c) of the Consumer Code (Italy); art. 17, no. 1, letter c) of Decree-Law no. 24/2014 (Portugal); art. 16, c) of Directive 2011/83/EU (Luxembourg); art. 40d para. 1 let. c Consumer Credit Act (Switzerland); Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (United Kingdom).

Legal reminder — Article L. 221-28, 3° of the French Consumer Code:

"The right of withdrawal cannot be exercised for contracts: [...] 3° For the supply of goods made to the consumer's specifications or clearly personalized;"

9.3. Pre-contractual information

The Customer is expressly informed of these conditions before validating the order, in accordance with article L. 221-5 of the French Consumer Code.


Article 10 — Legal guarantees

10.1. Legal guarantee of conformity

10.1.1. Principle

In accordance with articles L. 217-3 to L. 217-20 of the French Consumer Code, the Seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The Customer benefits from a guarantee of conformity of two (2) years from delivery of the goods. Customers residing in the other countries of delivery benefit from the equivalent legal guarantee of conformity provided for by their national law: Directive (EU) 2019/771 as transposed for European Union countries (the duration being extended to three years in Spain and Portugal); the Consumer Rights Act 2015 for the United Kingdom (30-day right to reject, then repair or replacement); art. 210 of the Code of Obligations for Switzerland.

10.1.2. Presumption of prior existence

Lack-of-conformity defects appearing within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise (article L. 217-7).

10.1.3. Customer's rights

In the event of a lack of conformity, the Customer can choose between repair and replacement of the goods (article L. 217-9). The bringing into conformity takes place within a reasonable period not exceeding thirty (30) days, at no charge to the Customer.

If bringing the goods into conformity is impossible, takes place beyond the 30-day period, or causes a major inconvenience, the Customer can obtain a price reduction or termination of the contract (article L. 217-10).

10.1.4. Return charges

Where the legal guarantee of conformity is invoked, return charges are borne in full by the Seller.

Mandatory extracts — French Consumer Code (guarantee of conformity):

Art. L. 217-3: "The seller delivers goods that conform to the contract and to the criteria set out in article L. 217-5. It is liable for any lack of conformity existing at the time of delivery of the goods [...]"

Art. L. 217-7: "Lack-of-conformity defects that appear within twenty-four months of delivery of the goods [...] are presumed to have existed at the time of delivery, unless proven otherwise."

Art. L. 217-9: "In the event of a lack of conformity, the consumer is entitled to have the goods brought into conformity by repair or replacement [...]"

Art. L. 217-10: "The consumer is entitled to a reduction in the price of the goods or to termination of the contract [...]"


10.2. Legal guarantee against latent defects

10.2.1. Principle

In accordance with articles 1641 to 1649 of the French Civil Code, the Seller is liable under the guarantee for latent defects of the item sold that render it unfit for its intended use, or that so diminish that use that the Customer would not have acquired it, or would have paid a lower price for it, had they known. Customers residing outside France benefit from the equivalent guarantees provided for by their applicable national law.

10.2.2. Customer's rights

The Customer can choose between returning the goods and obtaining a full refund of the price (redhibitory action), or keeping the goods and obtaining a price reduction (estimatory action), in accordance with article 1644 of the French Civil Code.

10.2.3. Time limit for action

The action must be brought within two (2) years of discovery of the defect (article 1648, first paragraph, of the French Civil Code).

Mandatory extracts — French Civil Code (latent defects):

Art. 1641: "The seller is liable under the guarantee for latent defects of the item sold that render it unfit for its intended use, or that so diminish that use that the buyer would not have acquired it [...]"

Art. 1648 para. 1: "The action arising from redhibitory defects must be brought by the buyer within two years of discovery of the defect."

10.3. Combination of guarantees

The Customer can choose to rely on the legal guarantee of conformity or the guarantee against latent defects, whichever is the more favorable.


Article 11 — Complaints and customer service

11.1. Reporting a defect

In the event of a lack of conformity, a latent defect or any anomaly observed, the Customer must inform the Seller by email at the address contact@kurtens.com, providing: their order number, a precise description of the defect, clear photographs of the product and of the defect.

11.2. Processing time

The Seller acknowledges receipt of any complaint within twenty-four (24) business hours and undertakes to provide a response within a maximum of fourteen (14) business days.

11.3. Product return

If a return is necessary, the Seller provides the Customer with a prepaid return label. Return charges are borne by the Seller in the event of a proven defect.

11.4. Refund

The refund is made within a maximum of fourteen (14) days from receipt of the returned product or from proof of its shipment. It is made using the same payment method as the one used for the order, unless the Customer expressly agrees otherwise.

11.5. Exclusions

The following do not give rise to a return, exchange or refund: made-to-measure products that conform to the order but for which the Customer provided incorrect measurements; products damaged by improper use, incorrect installation or a modification made without the Seller's agreement; normal wear and tear of the product.

Article 12 — Seller's liability

12.1. Seller's obligations

The Seller undertakes to supply products that conform to the order specifications and to comply with the delivery times announced.

12.2. Limitations of liability

The Seller cannot be held liable in the following cases: the Customer's failure to comply with these GTC; improper use of the product or incorrect installation; force majeure as defined in article 12.3; inaccuracy of the information provided by the Customer; indirect damages (loss of profit, loss of opportunity, commercial loss). These limitations do not apply to the legal guarantees of conformity and against latent defects, nor in the event of gross or wilful misconduct by the Seller, nor in the event of personal injury.

12.3. Force majeure

The Seller cannot be held liable for the non-performance of its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code. In the event of force majeure lasting beyond thirty (30) days, either party may terminate the contract without compensation.


Article 13 — Intellectual property

All elements of the Site (texts, photographs, images, logos, trademarks, graphic charter, videos, icons, software, database) are protected by the provisions of the French Intellectual Property Code and are the exclusive property of the Seller or its partners. Any reproduction, representation, modification, publication, distribution or transmission, without the prior written authorization of the Seller, is strictly prohibited.


Article 14 — Personal data

The collection and processing of the Customer's personal data in connection with the use of the Site and the placing of orders are carried out in accordance with the GDPR and the French Data Protection Act. The Customer is invited to consult the Site's Privacy Policy, accessible at any time on kurtens.com.


Article 15 — Consumer dispute mediation

15.1. Amicable settlement

In the event of a dispute relating to these GTC, the Customer is invited to contact the Seller first at the address contact@kurtens.com to attempt to find an amicable solution.

15.2. Consumer mediation

In accordance with articles L. 612-1 et seq. of the French Consumer Code, the Customer has the right to use a consumer mediator free of charge. The Seller will provide the Customer with the mediator's contact details upon request made to contact@kurtens.com.

15.3. Dispute resolution bodies by country

The European online dispute resolution platform (ODR) was closed on 20 July 2025 and is no longer available. Depending on their country of residence, the Customer may contact the following body:

For Swiss customers, the competent courts are those of the Customer's domicile.


Article 16 — Governing law and jurisdiction

16.1. Governing law

These GTC are governed by French law for French and European customers. For Swiss customers, the fundamental consumer rights provided for by the Swiss Code of Obligations (CO) and the Federal Act on Consumer Protection (LPC) are guaranteed to them. For British customers, the mandatory consumer rights provided for by the law of the United Kingdom (Consumer Rights Act 2015 and Consumer Contracts Regulations 2013) are guaranteed to them.

16.2. Jurisdiction

These General Terms and Conditions of Sale are governed by and construed in accordance with the laws of the State of New Mexico, United States. However, if you are a consumer residing in France, Belgium, Luxembourg, Germany, Spain, Italy, Portugal, Switzerland or the United Kingdom, this clause does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence. In the event of a dispute, you may bring the matter before the competent courts of your place of residence."


Article 17 — Partial invalidity

If any of the provisions of these GTC is declared null or unenforceable, that provision shall be deemed unwritten without affecting the validity of the other provisions, which shall remain in force.


Article 18 — Effective date and updates

These GTC come into force on the date indicated in the document header. The Seller reserves the right to amend them at any time. The amendments apply only to orders placed after their publication on the Site.
